\nVISTO il decreto legislativo 2 gennaio 2018, n. 1 recante “Codice della protezione civile”;
\nVISTO il decreto del Ministero delle infrastrutture e trasporti, 17 gennaio 2018 emanato di concerto con il Ministro dell’interno e con il Capo del Dipartimento della protezione civile, con il quale è stato aggiornato il testo delle norme tecniche per le costruzioni;
\nVISTA la direttiva del Presidente del Consiglio dei ministri 27 febbraio 2004 recante «Indirizzi operativi per la gestione organizzativa e funzionale del sistema di allertamento nazionale e regionale per il rischio idrogeologico e idraulico ai fini di protezione civile»;
\nVISTO, in particolare, il punto 3 della suddetta direttiva, che stabilisce i compiti, le funzioni e l'organizzazione della rete dei Centri funzionali per le finalità di protezione civile e dei Centri di competenza;
\nVISTA la direttiva del Presidente del Consiglio dei ministri 9 novembre 2012 recante “Indirizzi operativi per assicurare l’unitaria partecipazione delle Organizzazioni di Volontariato alle attività di protezione civile”;
\nVISTO il decreto del Presidente del Consiglio dei ministri 8 luglio 2014 recante “Istituzione del Nucleo Tecnico Nazionale (NTN) per il rilievo del danno e la valutazione di agibilità nell'emergenza post-sismica e approvazione dell'aggiornamento del modello per il rilevamento dei danni, pronto intervento e agibilità per edifici ordinari nell'emergenza post-sismica e del relativo manuale di compilazione”;
\nVISTE le Indicazioni operative del Dipartimento della protezione civile prot. 57046 del 29 ottobre 2020, per la formazione dei tecnici della pubblica amministrazione, delle Organizzazioni di Volontariato e professionisti iscritti agli albi di ordini e collegi, nell’ambito della “Valutazione dell’impatto, censimento dei danni e rilievo dell’agibilità post-sisma sulle strutture pubbliche e private e sugli edifici di interesse culturale”;
\nVISTE le Indicazioni operative del Dipartimento della protezione civile prot. 7761 del 12 febbraio 2021, per il raccordo e il coordinamento delle attività di sopralluogo tecnico, nell’ambito della “Valutazione dell’impatto, censimento dei danni e rilievo dell’agibilità post-sisma sulle strutture pubbliche e private e sugli edifici di interesse culturale”;
\nVISTO il decreto del Presidente del Consiglio dei Ministri 14 settembre 2012, recante la definizione dei principi per l’individuazione e il funzionamento dei Centri di competenza;
\nVISTA la direttiva del Presidente del Consiglio dei ministri 14 gennaio del 2014, recante “Programma nazionale di soccorso per il rischio sismico”;
\nVISTO il decreto del Ministro per la protezione civile e le politiche del mare 8 febbraio 2023 recante “Composizione e modalità di funzionamento della Commissione nazionale per la previsione e la prevenzione dei grandi rischi di cui all'articolo 20 del decreto legislativo 2 gennaio 2018, n. 1”;
\nVISTO il decreto del Ministro per la protezione civile e le politiche del mare 31 agosto 2023 recante “Nomina dei componenti della Commissione nazionale per la previsione e la prevenzione dei grandi rischi di cui all'articolo 20 del decreto legislativo 2 gennaio 2018, n. 1, in attuazione dell’articolo 2, comma 5 del decreto del Ministro per la protezione civile e le politiche del mare 8 febbraio 2023”;
\nVISTO il decreto-legge 12 ottobre 2023, n. 140, convertito, con modificazioni, dalla legge 7 dicembre 2023, n. 183, recante “Misure urgenti di prevenzione del rischio sismico connesso al fenomeno bradisismico nell'area dei Campi Flegrei”, che prevede misure urgenti per fronteggiare, anche mediante il ricorso a procedure semplificate e altre disposizioni di accelerazione, gli effetti dell'evoluzione del fenomeno bradisismico, in atto nell'area dei Campi Flegrei, nel territorio di alcuni comuni o parti di comuni della Città metropolitana di Napoli;
\nVISTO l’articolo 2 del citato decreto-legge n. 140/2023 che, nel prevedere la predisposizione e attuazione di un piano straordinario di analisi della vulnerabilità delle zone edificate direttamente interessate dal fenomeno bradisismico - da approvarsi con decreto del Ministro per la protezione civile e le politiche del mare, di concerto con il Ministro dell'economia e delle finanze, d'intesa con il Presidente della Regione Campania e sentiti la Città metropolitana di Napoli e i Sindaci dei comuni interessati, sulla base di una proposta tecnica formulata dal Dipartimento della protezione civile - dispone che lo stesso sia composto da: a) uno studio di microzonazione sismica; b) un'analisi della vulnerabilità sismica dell'edilizia privata, finalizzata all'individuazione di idonee misure di mitigazione e alla stima del relativo fabbisogno finanziario; c) un'analisi della vulnerabilità sismica dell'edilizia pubblica e, all'esito, un primo piano di misure per la relativa mitigazione, con apposito cronoprogramma, per la cui esecuzione possono essere attivati accordi con i competenti ordini professionali al fine di assicurare tempi certi, omogeneità e celerità dell'attuazione. Nel piano sono altresì disciplinate le modalità di monitoraggio e di revoca in caso di mancato rispetto dei relativi cronoprogrammi; d) un programma di implementazione del monitoraggio sismico e delle strutture;
\nVISTO il piano straordinario di analisi della vulnerabilità delle zone direttamente interessate dal fenomeno bradisismico, approvato il 26 febbraio 2024, con decreto del Ministro per la protezione civile e le Politiche del mare, di concerto con il Ministro dell’economia e delle finanze;
\nVISTO l’articolo 2, comma 3, del citato decreto-legge n. 140 del 2023 che prevede che, all'interno della zona di intervento il piano straordinario sia realizzato, con riferimento alle attività di cui al comma 1, lettera b), mediante procedure semplificate che non hanno il valore di verifica sismica ai sensi delle Norme tecniche per le costruzioni di cui al decreto del Ministro delle infrastrutture e dei trasporti del 17 gennaio 2018, individuate dal Capo del Dipartimento della protezione civile, con apposita ordinanza, d’intesa con la Regione Campania, con efficacia dalla data di adozione, in deroga ad ogni disposizione vigente e nel rispetto dei principi generali dell'ordinamento giuridico e delle norme dell'Unione europea, nel limite massimo di 3,5 milioni di euro per l'anno 2023;
\nCONSIDERATO che, con riferimento alle attività di cui all’articolo 2, comma 1, lettera b) – analisi di vulnerabilità dell’edilizia privata – del decreto-legge n.140 del 2023, il suddetto piano straordinario ha previsto al paragrafo 3.5, lettera a), che l’importo pari a 1.835.000,00 euro, assegnato al Dipartimento della protezione civile, sia da questo utilizzato per i rimborsi relativi ai tecnici rilevatori e per la stipula di specifici accordi con ordini e collegi professionali e/o con strutture di coordinamento tra i medesimi secondo le procedure semplificate che saranno riportate nell’ordinanza prevista ai sensi dell’articolo 2 comma 3 lettera b) del decreto-legge 140 del 2023, e ulteriori oneri connessi alle attività della presente misura;
\nCONSIDERATO che il Dipartimento della protezione civile dispone di strumenti schedografici di analisi già consolidati e condivisi con la comunità scientifica, sviluppati nell’ambito degli accordi del medesimo Dipartimento con i Centri di competenza che operano nell’ambito del rischio sismico e vulcanico;
\nCONSIDERATO che il Dipartimento della protezione civile dispone altresì di consolidati modelli organizzativi e di procedure tecniche per la valutazione, la rilevazione e la classificazione degli effetti degli eventi sulle opere e sulle infrastrutture pubbliche e private, dei danni subiti dalle attività economiche e produttive, dai beni culturali e dal patrimonio edilizio e che tali modelli organizzativi e procedure ben si adattano alla campagna di sopralluoghi tecnici necessari per dare attuazione all’articolo 2 del decreto-legge n. 140 del 2023, per quanto attiene all’analisi di vulnerabilità sismica dell’edilizia privata;
\nATTESA la necessità di procedere con urgenza all’attività di valutazione della vulnerabilità speditiva del patrimonio edilizio privato ordinario, prevalentemente destinato ad abitazione e/o a servizi, che consenta, rispetto ad un piano di verifiche condotto ai sensi delle Norme Tecniche delle Costruzioni 2018, di ottimizzare i tempi e le risorse economiche necessarie per consentire la celere individuazione di idonee misure di mitigazione sul costruito e la stima del relativo fabbisogno finanziario di cui al citato articolo 2, comma 1, lettera b) del decreto legge n. 140 del 2023;
\nTENUTO CONTO che gli strumenti schedografici PLINIVS, CARTIS e CARTIS-edificio, messi a punto, rispettivamente, nell’ambito delle convenzioni con il Dipartimento della protezione civile dal Centro studi per l’ingegneria idrogeologica vulcanica e sismica del centro interdipartimentale di ricerca - laboratorio di urbanistica e pianificazione territoriale - dell’Università Federico II di Napoli (PLINIVS-LUPT) e dalla Rete dei laboratori universitari di ingegneria sismica e strutturale (Consorzio Interuniversitario ReLUIS), così come i criteri e le modalità proposti per il loro impiego, sono stati ritenuti adeguati dal Settore Rischio Sismico della Commissione Grandi Rischi di cui all’articolo 20 del decreto legislativo n. 1 del 2018, nella seduta del 2 novembre 2023, al fine di dare attuazione all’articolo 2 del decreto-legge n. 140 del 2023, per quanto attiene l’analisi di vulnerabilità sismica dell’edilizia privata;
\nTENUTO CONTO che il Dipartimento della protezione civile, ai fini di dare attuazione all’articolo 2, comma 2 del decreto-legge n. 140 del 2023, ha proceduto ad una prima delimitazione della zona di intervento relativa all’attuazione del piano di cui all’articolo 2 del medesimo decreto e che quest’ultima è stata approvata dalla Commissione Grandi Rischi di cui all’articolo 20 del decreto legislativo n. 1 del 2018, nella seduta congiunta dei settori Sismico e Vulcanico del 3 novembre 2023;
\nATTESO che la perimetrazione di tale area di intervento, basata su parametri fisici e scientifici, è stata successivamente ridefinita e regolarizzata, anche in base ai confini amministrativi, da parte dei medesimi Comuni interessati e della Città metropolitana di Napoli, in raccordo con la Regione Campania e il Dipartimento della protezione civile ed è stata trasmessa dalla citata Città Metropolitana con nota acquisita al protocollo dipartimentale al n. 66862 del 27 dicembre 2023;
\nCONSIDERATO che la suddetta area include parte dei Comuni di Pozzuoli, Bacoli e Napoli (In particolare, con riferimento al Comune di Napoli, il Quartiere di Bagnoli all’interno della municipalità di Fuorigrotta-Bagnoli e porzione delle municipalità di Soccavo/Pianura e di Posillipo);
\nVISTO il decreto del Ministro per la protezione civile e le politiche del mare 8 novembre 2023 istitutivo della Struttura temporanea di supporto al Dipartimento della protezione civile ai sensi dell’articolo 2, comma 4, del decreto-legge n. 140 del 2023;

\nIL CAPO DEL DIPARTIMENTO DELLA PROTEZIONE CIVILE

I Campi Flegrei sono una vasta area vulcanica attiva caratterizzata dal fenomeno del \"bradisismo\": una deformazione del suolo che comporta fasi di lento abbassamento, alternate a fasi di sollevamento più rapido, queste ultime accompagnate generalmente da terremoti superficiali e di bassa magnitudo.
\nNel 2005 è iniziata una nuova fase di sollevamento della caldera, ancora in atto. Dal 2023 si è registrato un graduale incremento nella frequenza dei terremoti. La sequenza è culminata con gli eventi del 27 settembre e del 2 ottobre che hanno avuto rispettivamente magnitudo di 4.2 e 4.0.
\nPer rispondere alla crisi bradisismica in atto sono state potenziate le attività di monitoraggio del vulcano e, più in generale, sono state rafforzate le azioni di prevenzione del Sistema di protezione civile. In particolare, il decreto-legge n. 140 del 12 ottobre 2023 ha previsto misure urgenti di prevenzione del rischio sismico connesso al fenomeno bradisismico nell’area dei Campi Flegrei.
